These Terms and Conditions govern the use of the Indystry.cc website and the purchase of any products (physical or digital) from Kreatywny Schron Nikodem Bartnik, based in Bytom, Poland (VAT ID: PL6263035252).
By placing an order, you agree to these terms in full.
1. General Provisions
1.1. The store is operated by Kreatywny Schron Nikodem Bartnik, 41-923 Bytom, Poland.
1.2. We sell parts, kits, and digital build guides for DIY hobbyist projects.
1.3. Communication is handled via email at: nikodem@indystry.cc.
2. Digital Products (Build Guides & Files)
2.1. Digital products are delivered via a download link after payment is confirmed. 2.2. Refund Policy for Digital Goods: In accordance with Art. 38 of the Polish Act on Consumer Rights, the right to withdraw from a contract for digital content is limited:
- Refundable: If the product has not yet been downloaded/accessed.
- Non-Refundable: Once the download link has been clicked and the transfer of data has started, you lose your right to a refund. 2.3. By purchasing a digital product, you consent to immediate delivery and acknowledge that you lose the right of withdrawal once the download begins.
3. Physical Products (Parts & Kits)
3.1. The 90-Day Guarantee: We offer a 90-day return window from the date of purchase. If 90 days have passed, we cannot offer a refund or exchange.
3.2. Eligibility: To be eligible for a return, the item must be unused, in the same condition you received it, and in its original packaging.
3.3. B2B Sales: For orders placed by businesses (VAT-registered companies), returns are subject to a 15% restocking fee, and the 90-day window is at the sole discretion of Indystry.
4. Returns & Refund Process
4.1. Contact First: You must email nikodem@indystry.cc before returning any items to receive the correct return address.
4.2. Shipping Costs: The customer is responsible for all return shipping costs. Original shipping charges paid at the time of purchase are non-refundable. We recommend using a trackable shipping service. We are not responsible for returns lost in transit.
4.3. Processing: Refunds are processed to the original payment method within 31 days of us receiving and inspecting the returned item.
5. Shipping & International Orders
5.1. Global Shipping: We ship worldwide. Estimated times: EU (1-2 weeks), Non-EU (1-8 weeks).
5.2. Customs & Import Duties: For orders outside the European Union, the buyer is the Importer of Record. You are responsible for all import duties, taxes, and customs clearance fees required by your country.
5.3. Lost Packages: If a package is confirmed lost by the carrier, we will either send a replacement or issue a full refund.
6. Liability & Safety Disclaimer (Important)
6.1. Hobbyist Use Only: Indystry sells components and designs for DIY hobbyist projects. We do not sell finished, certified industrial machinery.
6.2. User Responsibility: The final safety, structural integrity, and electrical compliance of the finished machine (e.g., IndyMill) are the sole responsibility of the user/builder.
6.3. Limitation of Liability: Kreatywny Schron Nikodem Bartnik shall not be held liable for any personal injury, property damage, or financial loss resulting from:
- The assembly or operation of DIY machines.
- The use of third-party parts not supplied by us.
- The misuse of electronics (e.g., IndyShield) or mechanical components.
6.4. You acknowledge that working with CNC machines and electricity involves inherent risks.
7. Preorders & Backorders
7.1. Items marked as “Preorder” or “Backorder” ship at a later date as stated on the product page.
7.2. You may cancel a preorder for a full refund at any time before the item has shipped.
8. Privacy & Data Protection (GDPR)
8.1. Your data is processed in accordance with our Privacy Policy. We only collect data necessary for order fulfillment and legal tax obligations.
8.2. You have the right to access, correct, or request deletion of your data by contacting us.
9. Dispute Resolution
9.1. These terms are governed by the laws of Poland.
9.2. EU ODR Platform: If you are a consumer in the EU and have a dispute we cannot resolve, you may use the Online Dispute Resolution platform here: https://ec.europa.eu/consumers/odr/
